Tax Credit Extended!

I have great news for new home buyers out there! The First Time Home Buyer Tax Credit has been extended until April 2010!
Congress has recently passed the extension, with new legislation that:
- Extends the First-Time Home Buyer Tax Credit of up to $8,000 to first-time home buyers until April 30, 2010.
- Expands the credit to grant up to $6,500 credit to current home owners purchasing a new or existing home between November 7, 2009 and April 30, 2010.
So who qualifies?
- First-time home buyers who purchase homes between November 7, 2009 and April 30, 2010.
- Current home owners purchasing a home between November 7, 2009 and April 30, 2010, who have used the home being sold or vacated as a principal residence for five consecutive years within the last eight. Here is the important fact for existing homeowners, it must be a ‘primary’ residence as determined by living in the residence for 5 of the last 8 years. A primary residence includes: single-family homes, condos, townhomes and co-ops. However, if you have any questions, please do not hesitate to contact me at judy@judygull.com.
A few factors still impact the amount of tax credit that each individual/couple will receive:
- The price of the home.
- The buyer’s income.
1. Price
Under the new extension (effective November 7th, 2009) credit may only be awarded on homes purchased for $800,000 or less.
2. Buyer Income
Single buyers with incomes up to $125,000 and married couples with incomes up to $225,000—may receive the maximum tax credit.
These income limits have changed from the 2009 First-Time Home Buyer Tax Credit limits. If you purchased a home between January 1, 2009 and November 6, 2009, please see 2009 First-Time Home Buyer Tax Credit.
If you exceed these incomes, you may still be eligible to receive a portion of the tax credit:
For single buyers who earn between $125,000 and $145,000 the amount will decrease as you approach the maximum limit, if your income is greater than $145,00 you will not be eligible.
For those who filed jointly with an income between $225,000 and $245,000, you will still be eligible for a portion of the credit, but if your income is over $245,000 you will not be eligible for any credit.
FAQ: If I close on my new home after April 30, 2010 do I still qualify?
Under the Extended Home Buyer Tax Credit, as long as a written binding contract to purchase is in effect on April 30, 2010, the purchaser will have until July 1, 2010 to close on the property.
FAQ: Will the tax credit need to be repaid if I sell my home?
No and Yes.
NO, as the buyer you do not need to repay the tax credit if you occupy your home for three or more years.
However, the answer is YES if the property is sold during this three-year period, the full credit amount will be recouped on the sale.
